General Terms and Conditions – The Wildflower Club

Article 1: General

1.4. The Wildflower Club reserves the right to amend these Terms and Conditions from time to time. The new version will not apply retroactively. This means that the Customer is only bound by the Terms and Conditions that are available online on the day the order is placed.

1.5. Definitions:

Website: the domain and subdomains of The Wildflower Club.
Customer: the person placing an order.
Working day: a day that is not a Saturday, Sunday, or Dutch public holiday.
Order: the purchase of product(s) via the Website.
Content: all texts, images, videos, photos, and information on the Website.
Third-party websites: all websites not managed by The Wildflower Club.
Contract: the agreement concluded when placing an order.


Article 2: Order / Formation of Contract
2.1. The Customer is guided step by step through the ordering process via the Website. The Customer is responsible for checking all details before completing the order.

2.2. The Wildflower Club reserves the right to refuse an order, for example in case of payment issues or stock shortages. In such cases, the amount paid will be refunded.

2.3. All prices include VAT (where applicable). Shipping costs are displayed separately. Import duties may apply outside the EU.

2.4. Prices and product descriptions may be changed without prior notice.

2.5. Different payment methods are available per country. Cash payments and cheques are not accepted.

2.6. Discounts and promotions may be changed or withdrawn at any time.

2.7. By placing an order, the Customer agrees to these Terms and Conditions.

2.8. In the event of an obvious error or mistake in price indication, such as a printing error on a label or tag, the price as stated on the Website shall always prevail. No rights can be derived from evident pricing errors.


Article 3: Payment
3.1. Payment must be received in full before the order is processed.
3.2. After payment has been approved, the Customer will receive a confirmation by email.
3.3. Discount codes are not valid on gift cards and gift boxes.


Article 4: Delivery and Execution
4.1. The Wildflower Club handles orders with care and delivers to the address provided by the Customer.
4.2. The risk of loss or damage transfers to the Customer upon receipt of the order.
4.3. Shipping costs and options are displayed during checkout.
4.4. Incorrect address details are the responsibility of the Customer.
4.5. Free shipping applies from a certain order value, excluding gift cards.
4.6. If a parcel is returned due to not being collected, shipping costs will not be refunded.


Article 5: Right of Withdrawal
5.1. The Customer may withdraw from the order within 14 days after receipt without giving any reason.
5.2. The product must be returned via the return portal within this period.
5.3. The 14-day return period starts from the moment the parcel is delivered. If delivery to a pickup point is chosen, the return period starts when the parcel is delivered to that location.
5.4. After receiving the return, the amount (including shipping costs if the entire order is returned and excluding return costs) will be refunded within 14 days.


Article 6: Exclusion of the Right of Withdrawal
6.1. Products made to measure or not suitable for return for hygiene reasons are excluded from withdrawal.

6.2. For hygiene reasons, tights cannot be returned or exchanged, regardless of whether the packaging has been opened or not.


Article 7: Complaints Procedure
7.1. Complaints must be reported within 6 days after receipt, with a clear description.
7.2. The Customer will receive a response within 5 working days. If necessary, an acknowledgment of receipt will be sent first.
7.3. Products must comply with the agreement and legal requirements.


Article 8: Warranty
8.1. A warranty period of one month applies to clothing.
8.2. The warranty covers manufacturing defects under normal use.
8.3. Incorrect washing or use is excluded from warranty.
8.4. Incorrect sizing is not covered by warranty, but returns are possible.
8.5. Structural defects outside the warranty period are assessed based on a clear description and photos.
8.6. In case of a valid complaint, The Wildflower Club will offer repair, replacement, or (partial) refund.


Article 9: Returns
9.1. Returns must be registered within 14 days after receipt. The Customer then has an additional 14 days to return the item.
9.2. Products must be returned in original condition: unworn, unwashed, and with all original labels and tags attached. Products with removed labels or signs of use will not be accepted.
9.3. Discounts may be recalculated if returns affect discount conditions.
9.4. Returns must be registered via the return portal.
9.5. The Customer bears the costs and responsibility for return shipments.
9.6. Incorrectly labeled returns will not be processed automatically.
9.7. Refunds will be made within 10 working days after receipt.
9.8. If a product is damaged or defective upon receipt, the Customer must report this as soon as possible and no later than 14 days after receipt via support@thewildflowerclub.nl, including a description and clear photos of the defect. In such cases, The Wildflower Club will offer an appropriate solution, such as a free replacement or another form of compensation. If the Customer chooses not to use the offered solution and prefers to return the product without replacement, the return costs will be borne by the Customer.


Article 10: Privacy
10.1. Personal data is stored securely and only used for processing orders and personalized offers.
10.2. The Customer agrees to the use of third-party cookies.
10.3. Payment details are processed securely and are not visible to employees of The Wildflower Club.


Article 11: Applicability of the Terms and Conditions
11.1. These Terms and Conditions apply to every offer from The Wildflower Club and to every distance contract between The Wildflower Club and the Customer.


Article 12: Disputes and Applicable Law
12.1. These Terms and Conditions are governed by Dutch law. Disputes shall be exclusively submitted to the competent court in the Netherlands.
